TERMS OF SERVICE

By accessing or using https://www.packtally.com (the 'Service'), operated by Bram Van den Abbeele, an eenmanszaak (sole proprietorship) registered in Belgium, trading as PackTally ('PackTally', 'we', 'us', or 'our'), you agree to be bound by these Terms of Service ('Terms'). If you disagree with any part of these Terms, you may not access or use the Service.

DESCRIPTION OF SERVICE

PackTally is a price-comparison service for outdoor gear. We collect product information from third-party retailers and show each product once, with the offers of different retailers side by side, including prices, availability and variants such as colour and size. You can browse by category and brand and open product pages. If you create an account, you can also save favourites and set price watches.

PackTally does not sell products, and purchases are not made on our platform. The Service is currently free to use. We may update, change, suspend or discontinue the Service or any part of it for valid reasons, such as technical, security, legal or operational reasons. Where reasonably possible, we will give notice beforehand, in particular if we discontinue the Service as a whole or remove a feature that you actively use.

ACCURACY OF INFORMATION

Information about products, prices, discounts and promotions, availability, variants, specifications and features is obtained from third-party retailers and processed automatically. It may therefore be incomplete, outdated or incorrect, including as a result of data normalisation, the matching of listings across retailers, or currency conversion.

All product information is provided for general, indicative purposes only. Prices, promotions and availability reflect the moment they were last checked (where shown) and may change at any time without notice. Where prices are shown in your preferred currency, they are converted from the retailer's currency using indicative exchange rates, and the amount you are charged is determined by the retailer. The price, conditions and product description shown on the retailer's own website at the time of purchase are the ones that apply, and you are responsible for verifying them before you buy.

We do not warrant that product information is accurate, complete or up to date. This includes that a product has the features, specifications, sizes, colours or compatibility described, that a promotion or discount is valid, or that listings shown as the same product are in fact identical. To the maximum extent permitted by applicable law, and subject to the exceptions in the section 'LIMITATION OF LIABILITY' below, we are not liable for any loss or damage, including price differences, lost discounts or savings, or missed offers, resulting from your reliance on this information or from errors, omissions or delays in it.

If you notice an error, please let us know at [email protected]. We will try to correct it but are not obliged to do so within a particular time.

The Service contains links to the websites of third-party retailers. We do not control these websites and are not responsible for their content, products, prices, privacy practices, delivery, warranties, returns or customer service. Any purchase is made solely between you and the retailer, under the retailer's own terms. Retailer names, logos, trademarks, product names and images belong to their respective owners and are used only to identify products and offers. Their use does not imply any affiliation with or endorsement by those owners.

We may receive a commission from retailers when you follow a link from our Service and make a purchase. This does not increase the price you pay.

USER ACCOUNTS

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorised use of your account

You may delete your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms.

FAVOURITES AND PRICE WATCHES

Signed-in users can save favourites and set price watches on products. Price-watch notifications are provided on a best-efforts basis. We do not guarantee that a notification will be sent, will arrive on time, or will reflect the retailer's current price, and you should not rely on notifications as your only way of tracking an offer. If a product in your list is merged with or replaced by another product in our catalogue, we may move your favourites and price watches to the remaining product. If you delete your account, your favourites and price watches are deleted as well. See our Privacy Policy for how we handle your personal data.

AGE REQUIREMENTS

You must be at least 16 years old to create an account. By creating an account, you represent that you meet this age requirement. If we become aware that a user does not meet this requirement, we will terminate their account.

INTELLECTUAL PROPERTY

The Service and its original content, features, and functionality, including the structure and compilation of its database, are and will remain the exclusive property of PackTally and its licensors. Third-party names, logos, trademarks and product content remain the property of their respective owners. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of PackTally.

PROHIBITED USES

You agree not to use the Service:

  • In any way that violates applicable laws or regulations
  • To transmit unsolicited commercial communications (spam)
  • To impersonate any person or entity
  • To engage in any conduct that restricts or inhibits others' use of the Service
  • To attempt to gain unauthorised access to any part of the Service
  • To use automated scripts, crawlers or other tools to extract, copy or collect the content or database of the Service in bulk or systematically, except as allowed under 'Search engines and AI assistants' below
  • To re-use the price history or other substantial parts of the content or database, or to build, supply or enrich a competing database, comparison service or product with it
  • To train or fine-tune AI models on catalogue pages (product, category and brand pages and the price data on them)
  • To circumvent technical measures, rate limits or bot protection
  • To upload or transmit viruses or other malicious code

Search engines and AI assistants

We allow search engines and AI assistants that follow our robots.txt to index our pages and to quote or link to them in answers to a user's query. That kind of use is welcome: it is how people find PackTally.

Text and data mining

In accordance with Article 4(3) of Directive (EU) 2019/790, we expressly reserve the right to text and data mining of catalogue pages (product, category and brand pages and the price data on them), including the use of that content to train AI models. We also express this reservation in machine-readable form in our robots.txt and at /.well-known/tdmrep.json. We rely on the protection of the database right in the structure and compilation of our database, as described under 'INTELLECTUAL PROPERTY'. DISCLAIMER OF WARRANTIES

To the extent permitted by applicable law, the Service is provided on an 'as is' and 'as available' basis. We do not guarantee that: (a) the Service will function uninterrupted or error-free; (b) defects will be corrected; or (c) the Service is free of viruses or other harmful components. Nothing in this section affects any rights you have as a consumer under mandatory law, including any statutory rights relating to the conformity of digital services.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, PackTally shall not be liable for any indirect or consequential damage, including loss of profits, data, goodwill, or other intangible losses, resulting from your use of or inability to use the Service. Subject to the exceptions below, PackTally's total liability to you for all claims relating to the Service shall not exceed one hundred euros (€100).

Nothing in these Terms excludes or limits our liability for intent, fraud or gross negligence, for death or personal injury, for any liability that cannot be excluded or limited under mandatory law, or your statutory rights as a consumer.

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms or the Service shall be submitted exclusively to the competent courts of Ghent, Belgium.

If you are a consumer, nothing in these Terms deprives you of the mandatory consumer protection laws of your country of residence, or of any right under mandatory law to bring proceedings in the courts of your country of residence.

CHANGES TO TERMS

We may change these Terms for valid reasons, such as changes in law, changes to the Service, security or technical needs, or to correct errors. We will post the updated Terms on this page with a new effective date and, for users with an account, notify you by email or in-app notice at least 30 days before material changes take effect. If you do not agree with the changes, you can delete your account before they take effect. If you continue to use the Service after the changes take effect, the revised Terms apply to you.

SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, that provision will be applied to the extent permitted by law, and the remaining provisions will stay in effect.
